Spark Terms of Use

These Terms of Use ("Terms") govern your use of the Spark iOS application ("the App", "Spark", "we", "us", or "our"). By downloading, installing, or using Spark, you agree to be bound by these Terms.
1. License
Spark grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on iOS devices you own or control, in accordance with the Apple App Store Standard EULA, which applies in addition to these Terms.
2. Subscriptions and purchases
Spark is free to download and offers optional in-app purchases for Spark Pro features.
- Auto-renewable subscriptions (monthly and annual): payment is charged to your Apple ID upon purchase confirmation. Subscriptions auto-renew at the same price unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in Settings → Apple ID → Subscriptions on your iOS device.
- Lifetime in-app purchase (non-consumable): a one-time payment that grants Spark Pro access for the lifetime of the App on your Apple ID. Restored automatically across your devices.
- Refunds are handled by Apple under their refund policy. Contact Apple directly for refund requests.
3. Acceptable use
You agree to use Spark for personal, non-commercial purposes only. You will not:
- Reverse-engineer, decompile, or attempt to extract source code from the App.
- Modify, distribute, or create derivative works based on the App.
- Use the App to violate any applicable law or to infringe on the rights of others.
- Attempt to circumvent in-app purchase requirements or unlock Pro features through unauthorized means.
4. User content
Spark stores gameplay data, player names, and other content you create locally on your device and (for Pro users) synchronized to our cloud backend. You retain ownership of this content. You grant us a limited license to process and store this content for the sole purpose of providing the App's functionality (sync, history, stats). See our Privacy Policy for details.
5. Service availability
We strive to keep Spark available and functional, but we do not guarantee uninterrupted service. Cloud sync depends on third-party providers (Supabase, Apple) and may experience outages outside our control. The App is provided "as is" without warranties of any kind.
6. Changes to the App or Terms
We may update the App and these Terms from time to time. Material changes to these Terms will be communicated through an in-app notice the next time you open Spark. Continued use of the App after changes constitutes acceptance of the updated Terms.
7. Termination
You may stop using Spark at any time by uninstalling the App. We may suspend or terminate your access to the App if you violate these Terms. Upon termination, your local data remains on your device until you delete it; cloud data is governed by the retention policy in our Privacy Policy.
8. Limitation of liability
To the maximum extent permitted by law, Spark and its developer are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including loss of data, loss of profits, or business interruption. Our total liability is limited to the amount you paid for the App in the 12 months preceding the claim.
9. Third-party content
Spark is not affiliated with, endorsed, or sponsored by Wizards of the Coast LLC. Magic: The Gathering and Commander are trademarks of Wizards of the Coast LLC. Card data and images are sourced from Scryfall, a fan-run service, in accordance with the Wizards of the Coast Fan Content Policy.
10. Governing law
These Terms are governed by the laws of Spain. Any dispute arising from these Terms or your use of the App will be resolved in the courts of Barcelona, Spain, except where mandatory consumer protection law assigns jurisdiction to your country of residence.
